Is Paperless Working?

A benefit of going "paperless" is that we are now able to provide all of my office’s discovery via online access instead of the traditional "file" copy that has been used for the past thousand years. You may think this isn’t a big deal, but for government to do anything "cutting edge" is a bit unusual. While we have all adjusted to getting our banking information online, buying our airline tickets online, getting much of our news online and so on, we believe that we are the first prosecution office in the country to provide all discovery material online. But we aren't interested in doing it because it is "cool" but because it is a more efficient and  faster way of meeting our responsibilities in providing discovery in criminal matters.

July 1st DUI Laws Change

Georgia's new felony DUI law applies to offenses occurring on or after July 1, 2008. Under its provisions:

  • First and Second DUI Convictions are treated as misdemeanors.
  • Third DUI Convictions are treated as high and aggravated misdemeanors.
  • Fourth or Subsequent Convictions committed within ten years are treated as felonies.

Public Defenders' Council On Hot Seat

History has proven me right on this one: The Georgia Public Defenders' Council was never about better and more effective representation of the indigent, it has always been about power and control over the funds that are used to represent the indigent. I said then, and I say today, that Houston County should stay out of the state-wide public defender system as it is designed to fail. Sen. Preston Smith hits the nail on the head with his letter to the editor. Kelly Burke, Houston County District Attorney

Editors: The Georgia Legislature created a new statewide public defender system in 2003 to fulfill its constitutional obligation to provide an adequate criminal defense for indigents. However, there is a raging ideological debate between advocates and taxpayers over the meaning of an "adequate defense" that dramatically impacts the policy, structure and funding of the system.
