Career Criminal Gets Tough Sentence

Gerry Scott Holloway, 48 years old, from Warner Robins, pleaded guilty to burglary on Thursday September 20. He was sentenced by the Honorable Judge Katherine K. Lumsden in the Superior Court of Houston County to 20 to serve 14 years in prison without the possibility of parole.

Holloway was represented by Claudia Meier of the Public Defender's office. Holloway was prosecuted by the office of District Attorney Kelly R. Burke.

Holloway has a criminal record dating back to the late 1970s, and by his own admission is addicted to drugs. Under Georgia Law, defendants with three prior felony convictions can be sentenced to serve their time without parole. Holloway had at least twelve prior felony convictions including many for theft and burglary in counties all over Georgia. In 2006, Holloway was convicted of burglary in Fulton County. He was on probation for that offense when he burglarized a house on Highway 96 in Bonaire.

On March 23, 2007, the victim, Mr. James McMillan, went back to his house. He noticed a bicycle sitting next to his garage. When he went inside he saw a man in the living room. The man ran out of the front door and the victim went out of the garage door. The victim called 911 as he went around to the back of the house. They met in the backyard and the intruder yelled for someone to shoot the victim. The victim moved behind a tree but saw no other individuals in the area. The intruder then returned to the garage, took the bicycle, and fled.

Houston County Sheriff's Office responded and caught the suspect fleeing the scene. The suspect was identified as Gerry Holloway and was recognized by the victim as the intruder. A change dish in the house had been emptied of numerous coins and a large amount of change was found on Holloway's person. Holloway was interviewed by Cpl. James Williams and Lt. Jon Holland and confessed to the burglary. During the interview, Holloway claimed that alcohol had led to marijuana use, and then, ultimately an addiction to crack cocaine.

In the 2006 Fulton County burglary, Holloway had been apprehended fleeing the scene and had attempted to steal miscellaneous change. Holloway confessed to that burglary and was convicted under another name.

"Over and over again, this Defendant has gone into victim's homes and taken their property to support his addiction," said District Attorney Kelly R. Burke. Mr. Burke continued, "And over and over again, this Defendant has been given an opportunity in D.A. offices around Georgia to wake up and stop preying on his fellow citizens. The Court's sentence serves justice and is a warning about what can happen to career criminals when they decide to do their crime in Houston County."

Holloway is currently being held at the Houston County Detention Center awaiting transport by the Georgia Department of Corrections.

Another Drug Dealer Headed to Prison

Late Thursday afternoon (8/16/2007), a Houston County jury found Leon Springer guilty of Possession of Cocaine with Intent to Distribute and Possession of Cocaine with Intent to Distribute within 1,000 Feet of a Housing Project.  Judge Edward Lukemire sentenced Leon Springer to 20 years to serve 8 years in prison, and banished him from Houston County Housing Authority Properties.

Daniel Lee Berg pled guilty late Monday, August 13, 2007, to Felony Obstruction, Fleeing and Eluding (misdemeanor), Driving on a Suspended License, Failure to Stop, and Failure to Maintain Lane. He was sentenced by Judge Edward D. Lukemire to seven years, the first 21-24 months of which will be served in a probation detention center (no early release.)
